RESERVATION and cancellation POLICY

In order to book your reservation and to allow us to reserve your resources (hotel, food, transportation), we require a $1,500 deposit per person upon booking your adventure.  Full payment is due 90 days before your arrival date in Tanzania. If you book your trip less than 90 days prior to your arrival date, full payment is due at the time of reservation.  Failure to meet these deadlines will result in cancellation or non-booking of your reservation.

Once paid, the $1,500 deposit is non-refundable under all circumstances but may be applied to a future trip if you cannot attend this trip.  The balance of the fee is refundable if you cancel your trip at least six weeks prior to the trip start date.  If you cannot attend a trip for which payment in any amount has been made, you may find a suitable replacement for your trip with us.  If a suitable replacement is found with Dirty Freedom Adventures, you may transfer your payments to the replacement trip.  The replacement must agree to the terms of our terms and policies and this agreement. If you cancel a trip less than six weeks prior to the trip start date and do not find a replacement with us, all payments are non-refundable. 

Sometimes it might become necessary for us to cancel a trip due to  weather, foreign governments, government taxes or duties, terrain fluctuations, currency fluctuations, or changes in our costs.  We have complete discretion to effect any change of plans to accommodate any of these or other factors, including, without limitation, increases in trip fees, changes to the schedule or itinerary, and changes to means of transportation, when deemed necessary or advisable, without notice and without allowance of refund.  If we cancel, we will alert you as soon as possible.  Upon the cancellation of a trip, you will be given the option of either rescheduling the trip or reimbursement of the deposit or balance.  Upon repayment of your deposit or balance, we will be released from any liability whatsoever.

The deposits outlined above are required to reserve your spot and to take into account the time we will spend preparing for your arrival and arranging resources.  But we don't want you to lose your investment.  Therefore, we strongly recommend that you buy trip cancellation insurance at the time you book your trip.

You will also be required to execute a waiver and hold harmless agreement at the time of your first deposit.  We will provide this form to you after you register.  If you would like to review the agreement before reserving, please contact us. 

All services and agreements with us will be governed by the laws of Tanzania. 

 

MEDICAL CONCERNS

If you reserve a trip with us for any service, you represent and certify that you are fully capable to participate in the trip and the itinerary.  By time you reach Tanzania you represent and certify that you have undertaken sufficient training required to participate in the strenuous activities anticipated for the trip and the itinerary.  If you have any medical issues that could affect your trip, you must disclose them to us.

Limitations of liability

Dirty Freedom Adventures will not be liable to you (whether under the law of contract, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this website:

  • for any direct loss;
  • for any indirect, special or consequential loss; or
  • for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.

These limitations of liability apply even if Dirty Freedom Adventures has been expressly advised of the potential loss.

Reasonableness

By using this website, you agree that the exclusions and limitations of liability set out in this website disclaimer are reasonable.  

If you do not think they are reasonable, you must not use this website.

Other parties

You accept that, as a limited liability entity, Dirty Freedom Adventures has an interest in limiting the personal liability of its directors, officers, shareholders, and employees.  You agree that you will not bring any claim personally against Dirty Freedom Adventures' officers or employees in respect of any losses you suffer in connection with the website.

Without prejudice to the foregoing paragraph, you agree that the limitations of warranties and liability set out in this website disclaimer will protect Dirty Freedom Adventures' directors, officers, shareholders, employees, agents, subsidiaries, successors, assigns and sub-contractors as well as Dirty Freedom Adventures. 

Governing Law

This website will be governed by the laws of Tanzania.
